A person is guilty of a crime of the third degree if he fails to maintain books or records as required by the provisions of any State tax law and the regulations issued thereunder with intent to evade, avoid or otherwise not make timely payment of any tax, fee, penalty or interest, or any part thereof.

a. A person is guilty of a crime of the third degree if he fails to pay or turn over when due any tax, fee, penalty or interest or any part thereof required to be paid pursuant to the provisions of the State Tax Uniform Procedure Law, R.S. 54:48-1 et seq., as amended and supplemented, or any State tax law, with the intent to evade, avoid or otherwise not make timely payment or deposit of any tax, fee, penalty or interest or any part thereof.
b. The fact that any payment was made with a subsequently dishonored negotiable instrument shall constitute prima facie evidence that the actor failed to pay within the meaning of subsection a. of this section, and the trier of fact may draw a permissive inference therefrom that the actor did not intend to make the payment.

Owner of MG Group in Colts Neck charged with theft November 23, 2009

Irwin Nudelman, of North Brunswick, the owner and operator of MG Group on Route 34 South in Colts Neck has been charged with theft by deception. He was the general contractor on new residential construction projects throughout Ocean, Middlesex, and Monmouth counties. He hired MetroCorp Plumbing between February 2007 and May 2008 to provide services for MG Group to 17 homes in four developments. After MetroCorp completed the work, the properties were sold for between $850,000 and $1.3 million. However, Nudelman allegedly failed to pay $119,074.50 owed to the plumbing contractor.
Why is this a criminal case and not a civil case? Could be a number of issues, but my guess is that Nudelman ignored this instead of hiring a good attorney to clean up his mess. Now he really needs one. Story is here.

Attorney General Anne Milgram announced that a paid political consultant was charged today with the crime of impersonation in connection with deceptive “robocalls” made to more than 12,000 voters that attacked the two Republican incumbents in the June 2009 primary race for state Assembly in the 40th Legislative District. Kevin Collins of Brooklyn, N.Y., formerly of Wood-Ridge, N.J., was charged today by complaint-summons with impersonation, a fourth-degree crime, and violation of the Fair Campaign Practices Act, a disorderly persons offense.
It is alleged that Collins, who was a paid political consultant for Republican challengers Joe Caruso and Anthony Rottino, was responsible for automated phone calls or “robocalls” attacking the Republican incumbents, Assemblymen Scott Rumana and David Russo. The calls, which were made using a robocall service operated by an independent company, allegedly impersonated Assemblyman Rumana’s chief of staff, Ann O’Rourke. The calls featured the voice of a woman who identified herself as “Ann.”
It is alleged that Collins obtained the cellular telephone number of Ann O’Rourke and provided it to the robocall service company so that it would appear that the automated phone message originated from her and her cell phone. The robocall went to more that 12,000 residents of the 40th Legislative District on the day of the primary, June 2, 2009. The call made several inaccurate remarks about the incumbent assemblymen and encouraged recipients to vote against them. The call did not identify what campaign or political organization was responsible for it.
This is an interesting case because the guy has to get PTI. If he doesn’t, there is no reason not to take the case to trial. However, this is such a unique case that the State may want to make an example out of him. They could have him plea but still allow him into PTI so they can issue a press release that makes it seem like they got a conviction when they really didn’t. Should be interesting.
Former manager of Brock Farms Nurseries indicted for embezzlement November 23, 2009

Lynn Lormel, a former manager for Brock Farm Nurseries, is charged with second degree theft by deception in the one-count indictment handed up by a Monmouth County grand jury. An investigation by the Monmouth County Prosecutor’s Office found 145 separate instances of internal cash thefts from Brock Farms between April 2006 and July 2008 which totaled approximately $104,950.
She came under suspicion after a lawyer for Brock Farms notified the prosecutor’s office of the internal thefts. She was hired by Brock Farms in 2002 and she worked her way up to a position as the manager of the wholesale division. She was fired in July 2008 and arrested in February.
$67,493 in cash deposits were made to Lormel’s bank account during the same time span of the thefts which is rather interesting. I’m really not sure why she was indicted unless this case is going to trial. I have a great relationship with the Monmouth County Prosecutor’s Office. Most of them are really nice and have always worked with me to work out cases early. If she hired a good attorney in July of 2008, she may have been able to work all of this out. I know because I do it so often.
